i just plain do not shop at wal mart because of the way they treat their employees. also where i live fred meyers and safeway and sears have better quality made in america products and cleaner stores. the way to fisx walmart is not to shop there.

I know a deputy sheriff that was suffering from a terminal (without treatment) illness that switched to his wife's Wal mart insurance because it was better than his public employee health insurance. Wal Mart took him even though it was a preexisting condition and few employers would accept preexisting conditions. Walmart is in the wrong. Walmart did not do anything for the safety of the guard and customers. Walmart was stirring up the crowd outside before the doors were opened. They should have had some police ther but Walmart did not want to spend a little money for the police. Walmart is negligent and the manager should be arrested for negligent homicide.
I believe Walmart did nothing wrong. But it better to settle PR wise. The only thing I can come up with is use gates like they use with cattle or turnstiles. But at the same time their could be a crush on the front side of either.
Wal-mart is not entirely at fault. Yes they should have implemented crowd control, but they shouldn't have had the need to. That rests entirely on the misbehavior of the crowd who vandalized the store by breaking down the doors, and whose actions resulted in manslaughter and assault. How many people walk up to a store, see a crowd forming in front of it, and attempt to form a queue? How many others ignore those queues and act like they own the damn planet. They're just as much at fault as Wal-mart, and every single one of those 2000 people should have been arrested on manslaughter charges.
All Wal-mart has to do from now on is put out a few of those rope stands like at movie theaters and have the cops arrest anyone who doesn't use the queue.
At my Neighborhood Walmart, I find that the store itself is very well-maintained, and I find that most of the employees there are very friendly. Now, the pharmacy is a different story for me, as the people in the pharmacy seem very mad at something all the time. Not mad at the customers, but just mad at the world in general, so their pharmacy doesn't get my business.
And, really, you can't beat the prices if you shop carefully!
One year ago, I probably would have agreed with you. This summer, when my relatives were visiting from Australia, they wanted to go to Walmart. I was hesitant because, like you, I was thinking low class, messy, dirty, cheap junk!
What a surprise I got! We went to the Walmart in Rancho Cucamonga, CA. It is in one word beautiful. Clean, large isles, clearly marked merchandise, and the people were so friendly, not to mention the prices - man! Amazing! I walked around the store with my mouth hanging open for more than an hour. What a find!
I'm not trying to brag, but my husband and I both work and we make a nice living. I would no more shop at some high-end store just because I did not want to be seen at Walmart. I go there all the time now. You can't beat their prices on everything from clothes to groceries.
Re: "Black Friday" I don't know what to think about that. I suppose the store should have prepared better, especially if they saw crowds forming. It is really awful what happened, and it could have been a member of my family.
Every time I read something like this it pizzes me off. This is nothing more than two things.
One is that an absolutly innocent man was killed just trying to do his job and care for his family.
Two is that Walmart had no chance to forsee that 2000 people would behave like a herd of thoughtless cattle stampeeding through the doors. If there is anyone to blame, it is the 2000 morons that broke down the doors to get inside. They didn't even wait until the store was open. As far as Walmart " stirring up the crowd ". Well I imagine that every store was guilty of that on the day after Thanksgiving. Apparently stirring up the crowd means you are going to be open that day, and have a sale. There was lots of video of this, and it bothers me to no end that there was never anything done by the police to attempt to identify the people that broke the door in, and those that were doing the pushing and stampeding that killed one man and injured others. That is where the real blame should rest. Not with Walmart. But Walmart is the one with the deep pockets, so they get the blame, and the bill.
Then there is the lawyer for the man that was murdered by the crowd. He's upset that instead of going to court and paying a $10,000 fine, Walmart is paying out millions of dollars , and claiming Walmart is taking the cheap way out by paying someone off.I imagine he's actually upset that he may very well lose other clients that he can use to file civil suits against Walmart for millions of dollars for a twisted ankle.
The worst part is that all this is doing is making it even more apparent that in our society no one is responsible for what they do anymore. If you do something that injures someone, it is some big corpaorations fault. Not yours.
Yeah I kicked the door in 20 minutes before the store was supposed to open. And yeah I yelled as loud as I could to the crowd " there open, lets go ". And yeah I knocked the little bastard out of my way so I could be the first one in the store. But it's not MY fault that someone got hurt. It's Walmarts fault. Walmart did have fault in the fact that they lacked crowd control, but all those people who stormed the store are just as guilty! How dare they work themselves up the way they did. There were black Friday sales all over the place and no one else was killed! That's because the customers controlled themselves! And acted like human beings, not animals!
The problem was caused because Wlamart has been offering a few really desirable, expensive items at "barn burner" prices. They do that to draw customers in. Customers get angry and aggressive because they see a few people get the item and they do not.
I find Walmart clean, good prices and they carry no more foreign items than the rest of American stores.
And - they are one of the few employers in my area. The so called "mom and pops" hired only their relatives and had terrible business practices.
Walmart is responsible for the accident because they set up a situation that lead to the death. They should never offer "come on" items without using a procedure that clearly protects both customers and employees.
The people acted poorly? Stores, schools, hospitals, etc need to take that into account and act accordingly. Walmart is responsible because they ignored the potential "bad" behavior of customers.
I personally agree with bob-311683 I try to shop Fred Meyer's stores too because they do carry a better variety of items...that and they carry local or regional items too. They use the local farmers to stock their bins for produce etc when it is in season.
As for the safety of the issue....why do they not just do what Best Buy and all the other "Big Box" stores have implemented...a line is formed outside the doors and a worker an hour or so before the store opens starts at the beginning of the line and offers "tickets" for any of the big box items that are being offered. When the tickets are gone, then you know whether or not you will be able to get that item. Saves a lot of time and rough crowds and makes it a tad bit more orderly when you get in the doors. Take a hint Wal-Mart...you don't have to hire big safety corporations to set it up for you actually quite simple, count how many of the product you have, print up the tickets and hand them out!
This is absolutely ridiculous. How is wal-mart anymore at fault than the State? they put the codes in place that Wal mart was in compliance with. And for Walmart to pay blood money to the state of which the victims family will see nothing is absurd. This is just a government political shakedown.

I don't neccesarily believe Wal-Mart itself is at fault... the patrons were the ones that stormed the door. But I do believe that a company has the responsibility to insure its customers safety.
I have shopped the sales on black friday for years and the only time I have ever been fearful of the crowds was 2 different years I went to Wal-Mart. I don't mean to be rude when I say this, as I have shopped at Wal-Mart a few times myself... but there is a Wal-mart mentality when it comes to alot of the patrons. No where else have I ever seen people pushing and shoving on black friday like I have the 2 years I went to Wal-Mart. It is this reason that for the last 2 years I have not patronized Wal-Mart on black friday and I never will again, no matter what they have on sale that day. it's just not worth it!The owners of Wal-Mart need to be aware that they attract certain people, and do whatever is neccesary to insure the safety of their customers.
Look at the tags inside the cloths most stores either sale stuff from china, India and a few other third world con tries. I wanted Jeans made in America and there wasn't a store that had any. Even Levies are not made here. The material gets holes in them in just a few months..But you can go on line and find some small factories that are in this country and make the jeans out of cotton grown and made in this country. Pointer is the name can either get them at a farm store or write the factory.You pay a few dollars more but stand up for several years. I don't care for walmarts since the son's took over they use to be proud to have things made in this country but they aren't anymore very few stores have clothing made in this country.This includes tools that fall apart.Go on line and find what you want. just type in American factories, or American clothing.

My son worked at Sears before he deployed to Iraq the 1st time in 2006 as a member of the Wisconsin Army NG. When he got back he went to Sears after 14 days (the law gives returning soldiers 30 days) to get his job back...Oops no openings except a 12-15 hour a week temporary seasonal position. He filed the complaints the JAGS followed through, Sears paid a fine and he got a job at Walmart for more money during a time when if you admit you are in the Guard nobody wants to hire you. SO I have not shoped a Sears since nor will I ever shop at Sears again (and no since they own K-Mart I do not shop there either).
SImple solution is to have enough of the "barn burners" in stock so people can take their time and get into the store to find them. Friends of mine went and got in line at the local WM over and hour before they opened. They had a dvd device they wanted to purchase. They were like the thrird people back from the door when it opened and went directly to the electronics dept only to find they were sold out..... Not only WM but all of these stores violate state laws on disclosing how many of a sale item they plan to have in stock making it a stampede when the doors open. Talking to some of the kids that work at some of these stores they tell me on major sales sometimes they do not even have 1 of some of the items they advertise.
Absolutely was NOT Wal-Mart's fault. Had Wal-mart gone and hired police or had better crowd control, I will guarantee... RACISM would have been called on them for the fact they didn't employ those methods at EVERY Wal-mart across the country, just at the "typically black" New York one.
If you get a chance-- take a look at the tape that was shown -- almost EVERY PERSON who rushed the story kept right on going even though people were falling and getting trampled. Did they stop or care? NO. But the company is responsible?

Next is the fact that believe it or not (I think you don't) Walmart is actually paying out way more than they had to. WAY more. All that they had to do was take it to court, and the maximum they would have been hit with was $10,000. There is no doubt that they knew that, but decided anyway to pay out MILLIONS of dollars, even though they did not have to.
As far as the unfortunate individual that lost his life, Walmart never had a chance to " step up ", as the mans family retained an attorney and refused to deal with Walmart out of court.

Walmart wasnt the one that did the trampling, if anything they should have used the stores video cameras and arrested anyone that was tampling in on the person, of course that probably would have been more labor intensive than just suing walmart, plus it isnt as interesting to arrest the responsible people.
Are you guys totally vacant between the ears? No WalMart was not at fault; there was no way they could have foreseen the crown would act as they did. But, Redphish, the ADA sad at not padding her own retirement? The ADA is the one that brokered the deal to begin with! And, Chris, it was not the ADA who decided to bring charges. If it was a Grand Jury case, it would have been presented to a group of citizens who had been enpaneled for just that purpose. They would have reviewed all of the evidence and determined if there was sufficient evidence to bring a GJ trial. Rice did not arbitrarily decide after breakfast one morning to go knock down WalMart.
Lastly, Freedom Writer, the police did use the footage from the security cameras. It was virtually impossible for them to pull up any single identifiable person who may have been among of those responsible for the man's death. Which ones among the 2,000 + people in the crowd actually contributed to the death? Some actually discovered the man down and attempted to shelter him from the onslaught. So who do we charge?
Perhaps the rational thing to do at this point is to vow to improve our own conduct in the world. Accept that we are not alone here on this Earth; stop thinking that we have some special entitlement beyond the rest. Quit running red lights and stop signs. Stop racing to get through yellow lights. Hold the door for the person coming through immediately behind you so it won't hit them on their way out. We do it all the time, rush past people to get "there" first. Just because the last time you ran through the elevator door ahead of someone else it didn't result in death, doesn't make you any better than the people at the Nassau Co. WalMart. Maybe we just need to stop and take a minute to think about how we can change our own lives for the better instead of spending so much time condemning others for something than we cannot change.
I disagree with the comments about Walmart not doing anything wrong. There was a reasonable certainty that the crowd would rush the store at opening. It is so blatant and obvious that marketing companies have even made humor out of the rush. There are commercials on TV that depict a temp being the "stuckee" because he is the low man on the employee totem pole that has to face the onslaught. For Walmart to claim it had no reason to believe that their flyers sent out announcing a "limited inventory barn burner" item would not cause pandemonium is ludicrous.
I am normally against lawsuits for compensation of corporate negligence but this one reeks to high Heaven. For the prosecutor to sell out to Walmart makes me believe that there are some underlying motives. I hope that the families of the injured ignore the pittance settlement and go after Walmart individually or collectively.

I hate Wal-Mart with all of my being... but I agree. I don't think they should be accountable for the actions of their customers. Personally, I avoid both Wal-Mart and Black Friday sales because of the shoppers you find there. I shop online only during the holiday season. :)

It seems everyone wants to slap the greed sticker on big business, politicians, law makers, and ceos... Guess what? If the public society is greedy and over indulged how the hell does anyone think that it's corporations and leaders will not be the same way? Anyone ever think thats the reason why greed thrives?
Enough blame to go around, I guess. They went after WalMart because they can't determine which shoppers were responsible and others were injured as well. It was an "accident" but avoidable as many accidents are. Ultimately, all the shoppers were responsible. Retailers need some crowd control procedures, so Wal Mart is also responsible.
I am curious if any of the shoppers who were present that day bothered to contact the worker's family, maybe send some flowers or donations for the funeral cost, attend the funeral, whatever, something to show some compassion or sorrow for the worker's family. Anonymously if they were concerned about criminal charges. Hopefully it made them think about the next time there was a crowd where they shopped and maybe just think about the other person. Maybe. Hopefully. Or likely, "it wasn't my fault".
I had a kid working for me who was involved in the who concert in cincinnati Ohio a number of years back. This was the first attempt at what they called festival seating. You buy a ticket and sit where ever there was a seat available. The concert people only hired the normal number of security agents as they did for a normal concert. Barney told me he arrived early and was about 4 rows back from the door when they opened it and he said he was suddenly inside 10 yards from where he was standing before the doors opened and his feet had not touched the ground on the way there.
How are you going to tell who was pushing who walked on somebody in a crowd like this . So how are you going to prosecute anyone. It is the responsiblity of the event planners to have enough security to prevent this sort of thing from happening.

Most of you folks are crazy. Wal Mart has probably done more to improve the quality of life for Americans than anyone I know. They have brought the price of essential goods down amazingly for everyone but the poor have benefited most.
I go to Wal Mart and look at the people working there and see that they hire people that often would be rejected at high end shopping outlets giving them a chance to have a job.
It is more trouble to shop there because of the volume of traffic, but i do it because it saves me about 20% or more.

I have talked with many employees......Hate the job, over worked, working shifts they didn't sign up for and the list goes on. If you get a happy employee I am thinking it is a new hire.

So what NY has said is the value of a human life is $2 million dollars. They did not file CRIMINAL charges in a persons death because Walmart paid $2 million. Nice.

Walmart agreed to $2 million to avoid a $10,000 fine and you think they got over on someone?
Had they gone to court and lost, they would have had to pay the $10,000 fine. But it would have left them open to a civil lawsuit which could have potnentially ended in more than 2 million. Now they can't be sued for this again.
It's not paying $2 million vs. paying $10,000. How much do you think the litigation over several years would have cost versus shutting down the case now? In addition, they got to settle and admit to no wrongdoing. If they went to Trial and lost, what kind of bad press do you suppose they would have gotten.
Bottom line, the settlement decision was based purely on money.
They can still be sued it would of just been a stronger case if they were found criminally negligent. The Attorney is upset because he wasnt given a chance to strong arm wal mart before they settled. He is doing his job but if you dont think attorneys are bastards you must not know any.

I think the reason Walmart was held responsible is that the management at the store had to see how many people were crowding outside the doors before opening, and should've known there was a possibility of someone getting hurt. But let's be honest about Walmart, it's not a place most of us would want to work, and those who do, have to work there because that's all that's out there or that's the best they can do! Their employeee rah rah motivational meetings are required and demeaning to anyone with an ounce of intelligence. I'm going by the stories I've watched on television about the chain. They've kept their costs down by limiting employee benefits, and only after extensive news coverage of the way they stuck it to those who work for them, did they make some changes. Corporate profit over all else has put us in the situation we're in now. Sure, people bought homes they could'nt afford. But how many of those people thought the realtor, and banker who do this for a living and are far smarter than they are did so on their advice? After knowing about three different lawsuits against Walmart, I can say that they are indeed guilty of unfair practices. A friend was knocked over by one of their dairy carts, and when she fell into a dairy case, the employee, rather than helping her, told her to go fill out an accident report. She did that, then went to a hospital the next day only to discover that she had permanent neck and head injuries. When she was released from the hospital, she went back to Walmart to get a copy of the accident form to show her insurance company and the hospital. Alas, Walmart couldn't produce the complaint nor the employee that handled it. He had been transfered to another store out of state. I see something here that is bothersome. How can a DA make such a proposal without considering the burden on that poor person trampled to death? To let the state get involved with a cfivil suit, is pure bull. That same thing happened here in Michigan, Walmart always gets off the hook without taking any responsibility for anything, ever. I think that it is unfair that the power they have with their legal teams that they never have to pay the price for anything. I never shop at Walmart. I don't like what they have done to the general retail market across the country. While they supply our needs with cheap goods made overseas with cheap labor, they take away American jobs, destroy community business', and when they have finally done away with all the competetion, we will wake up to a different story. When that happens and they decide to raise prices sky high, we won't have a choice as to where to buy, all the competition will be long gone. This country was built by Americans with small businesses. We allow our banking, retail, and industrial giants dictate their agenda to us and we take it gullably. We see local businesses close their doors, banks take our assets to Wall Street and Industry ship our jobs overseas and they still have the gall to hide assets in the Caymans to aviod taxation. It is time to dismantle big business, take back our industry, and tell the banking system to keep our money in our communities or get out of our communities. The best step is to close your bank accounts, deposit them in Credit Unions and buy only American goods made by Americans in America. Tell congress you are tired of being controlled by big business and the banking "CARTELS". If you don't think your being swindled, why aren't we making the same amount of interest on CD's that the banks charge on credit cards? Why not?

My experience with Walmart was different. My wife was taking something off a shelf and someone had placed a hunting knife still in the plastic on top of the item my wife was getting down. Then the knife fell off the top she reached out and caught it. The knife punctured the package and my wifes hand. It resulted in a trip to the emergency room and several stitches. They asked me to fill out a report and I told them I needed to take my wife to the hospital. I left them my name and number. A manager called me the next day to find out what happened. I told him the story and he made sure we were reimbursed for all the emergency room expenses and called back a month later to make sure everything was ok with my wifes hand.
I didnt sue them because I know it wasn't their fault. But they did treat me as fairly as can be expected. and took care of all the medical.
It is funny that your friend filled out her own report, first off only a salaried member of management can fill one out. They take information from the person. A copy of it has to be in Home Office's hands in 24 hours or less. It happens just like Brad O'Neil said it did his wife. Secondly, Walmart does not transfer employees like that. A employee has to request themselves a transfer, then find a store with a opening for them. This can take a month or more to do. So no one just disappears, even if the person had already applied for a transfer all they had to do was call the new store. DUH....
And to everyone complaining about Walmart benefits...You have NO idea what you are talking about. Where else can you go and get insurance starting at less than $20.00 a month. The cost is based on what you take out. I have a $500 up front Walmart pays 100% credit, then a $1,000 deductible, then 80/20, with a total out of pocket expense of $5,000 and I pay $40 a month. That is a whole lot better than most programs out there.
As to the workers being uneducated...85% have at least an ASS Degree, if not higher.

What should have happened is they should have used the security cameras and found the people who trampled him to death, rounded them up, filed murder charges on them and held them liable for civil damages. I'm glad Wal-Mart is reconizing the victim but, the real criminals were those stampeding animals called 'shoppers'. Every one of them should be tracked down and charged with manslaughter but, I guess that would mean the police and D.A. would have to get off their butts and do something.

I shop on Saturday and Sundays and Black Friday. The WalMart in my area had the same deals and no one acted the way these people did. The procedures were the same. My wife works in retail and has days off during the week and I work nights and would be unable to shop during the week without taking a day off. Whoever said, you need Saturday and Sunday off to make a weekend (I guess the same on who said Breakfast is for mornings only).

I know a deputy sheriff that was suffering from a terminal (without treatment) illness that switched to his wife's Wal mart insurance because it was better than his public employee health insurance. Walmart is in the wrong. Walmart did not do anything for the safety of the guard and customers. Walmart was stirring up the crowd outside before the doors were opened. They should have had some police ther but Walmart did not want to spend a little money for the police. Walmart is negligent and the manager should be arrested for negligent homicide.
I believe Walmart did nothing wrong. But it better to settle PR wise. The only thing I can come up with is use gates like they use with cattle or turnstiles. But at the same time their could be a crush on the front side of either.
Wal-mart is not entirely at fault. Yes they should have implemented crowd control, but they shouldn't have had the need to. That rests entirely on the misbehavior of the crowd who vandalized the store by breaking down the doors, and whose actions resulted in manslaughter and assault. How many people walk up to a store, see a crowd forming in front of it, and attempt to form a queue? How many others ignore those queues and act like they own the damn planet. They're just as much at fault as Wal-mart, and every single one of those 2000 people should have been arrested on manslaughter charges.
All Wal-mart has to do from now on is put out a few of those rope stands like at movie theaters and have the cops arrest anyone who doesn't use the queue.
At my Neighborhood Walmart, I find that the store itself is very well-maintained, and I find that most of the employees there are very friendly. Now, the pharmacy is a different story for me, as the people in the pharmacy seem very mad at something all the time. Not mad at the customers, but just mad at the world in general, so their pharmacy doesn't get my business.
And, really, you can't beat the prices if you shop carefully!

One year ago, I probably would have agreed with you. This summer, when my relatives were visiting from Australia, they wanted to go to Walmart. I was hesitant because, like you, I was thinking low class, messy, dirty, cheap junk!
What a surprise I got! We went to the Walmart in Rancho Cucamonga, CA. It is in one word beautiful. Clean, large isles, clearly marked merchandise, and the people were so friendly, not to mention the prices - man! Amazing! I walked around the store with my mouth hanging open for more than an hour. What a find!
I'm not trying to brag, but my husband and I both work and we make a nice living. I would no more shop at some high-end store just because I did not want to be seen at Walmart. I go there all the time now. You can't beat their prices on everything from clothes to groceries.
Re: "Black Friday" I don't know what to think about that. I suppose the store should have prepared better, especially if they saw crowds forming. It is really awful what happened, and it could have been a member of my family.
Every time I read something like this it pizzes me off. This is nothing more than two things.
One is that an absolutly innocent man was killed just trying to do his job and care for his family.
Two is that Walmart had no chance to forsee that 2000 people would behave like a herd of thoughtless cattle stampeeding through the doors. That is where the real blame should rest. Not with Walmart. But Walmart is the one with the deep pockets, so they get the blame, and the bill.
Then there is the lawyer for the man that was murdered by the crowd. He's upset that instead of going to court and paying a $10,000 fine, Walmart is paying out millions of dollars , and claiming Walmart is taking the cheap way out by paying someone off.I imagine he's actually upset that he may very well lose other clients that he can use to file civil suits against Walmart for millions of dollars for a twisted ankle.
The worst part is that all this is doing is making it even more apparent that in our society no one is responsible for what they do anymore. If you do something that injures someone, it is some big corpaorations fault. Not yours.
Yeah I kicked the door in 20 minutes before the store was supposed to open. And yeah I yelled as loud as I could to the crowd " there open, lets go ". And yeah I knocked the little bastard out of my way so I could be the first one in the store. But it's not MY fault that someone got hurt. It's Walmarts fault. Walmart did have fault in the fact that they lacked crowd control, but all those people who stormed the store are just as guilty! How dare they work themselves up the way they did. There were black Friday sales all over the place and no one else was killed! That's because the customers controlled themselves! And acted like human beings, not animals!

The problem was caused because Wlamart has been offering a few really desirable, expensive items at "barn burner" prices. They do that to draw customers in. Customers get angry and aggressive because they see a few people get the item and they do not.
I find Walmart clean, good prices and they carry no more foreign items than the rest of American stores.
And - they are one of the few employers in my area. The so called "mom and pops" hired only their relatives and had terrible business practices.
Walmart is responsible for the accident because they set up a situation that lead to the death. They should never offer "come on" items without using a procedure that clearly protects both customers and employees.
The people acted poorly? Stores, schools, hospitals, etc need to take that into account and act accordingly. Walmart is responsible because they ignored the potential "bad" behavior of customers.
I personally agree with bob-311683 I try to shop Fred Meyer's stores too because they do carry a better variety of items...that and they carry local or regional items too. They use the local farmers to stock their bins for produce etc when it is in season.
As for the safety of the issue....why do they not just do what Best Buy and all the other "Big Box" stores have implemented...a line is formed outside the doors and a worker an hour or so before the store opens starts at the beginning of the line and offers "tickets" for any of the big box items that are being offered. When the tickets are gone, then you know whether or not you will be able to get that item. Saves a lot of time and rough crowds and makes it a tad bit more orderly when you get in the doors. Take a hint Wal-Mart...you don't have to hire big safety corporations to set it up for you actually quite simple, count how many of the product you have, print up the tickets and hand them out!

I have shopped the sales on black friday for years and the only time I have ever been fearful of the crowds was 2 different years I went to Wal-Mart. I don't mean to be rude when I say this, as I have shopped at Wal-Mart a few times myself... but there is a Wal-mart mentality when it comes to alot of the patrons. No where else have I ever seen people pushing and shoving on black friday like I have the 2 years I went to Wal-Mart. Look at the tags inside the cloths most stores either sale stuff from china, India and a few other third world con tries. I wanted Jeans made in America and there wasn't a store that had any. Even Levies are not made here. The material gets holes in them in just a few months..But you can go on line and find some small factories that are in this country and make the jeans out of cotton grown and made in this country. Pointer is the name can either get them at a farm store or write the factory.You pay a few dollars more but stand up for several years. I don't care for walmarts since the son's took over they use to be proud to have things made in this country but they aren't anymore very few stores have clothing made in this country.This includes tools that fall apart.Go on line and find what you want. just type in American factories, or American clothing.

My son worked at Sears before he deployed to Iraq the 1st time in 2006 as a member of the Wisconsin Army NG. When he got back he went to Sears after 14 days (the law gives returning soldiers 30 days) to get his job back...Oops no openings except a 12-15 hour a week temporary seasonal position. He filed the complaints the JAGS followed through, Sears paid a fine and he got a job at Walmart for more money during a time when if you admit you are in the Guard nobody wants to hire you. SO I have not shoped a Sears since nor will I ever shop at Sears again (and no since they own K-Mart I do not shop there either).
SImple solution is to have enough of the "barn burners" in stock so people can take their time and get into the store to find them. Friends of mine went and got in line at the local WM over and hour before they opened. They had a dvd device they wanted to purchase. They were like the thrird people back from the door when it opened and went directly to the electronics dept only to find they were sold out..... Not only WM but all of these stores violate state laws on disclosing how many of a sale item they plan to have in stock making it a stampede when the doors open. Talking to some of the kids that work at some of these stores they tell me on major sales sometimes they do not even have 1 of some of the items they advertise.
Absolutely was NOT Wal-Mart's fault. Had Wal-mart gone and hired police or had better crowd control, I will guarantee... RACISM would have been called on them for the fact they didn't employ those methods at EVERY Wal-mart across the country, just at the "typically black" New York one.

Are you guys totally vacant between the ears? No WalMart was not at fault; there was no way they could have foreseen the crown would act as they did. But, Redphish, the ADA sad at not padding her own retirement? The ADA is the one that brokered the deal to begin with! And, Chris, it was not the ADA who decided to bring charges. If it was a Grand Jury case, it would have been presented to a group of citizens who had been enpaneled for just that purpose. They would have reviewed all of the evidence and determined if there was sufficient evidence to bring a GJ trial. Rice did not arbitrarily decide after breakfast one morning to go knock down WalMart.
Lastly, Freedom Writer, the police did use the footage from the security cameras. It was virtually impossible for them to pull up any single identifiable person who may have been among of those responsible for the man's death. Which ones among the 2,000 + people in the crowd actually contributed to the death? Some actually discovered the man down and attempted to shelter him from the onslaught. So who do we charge?
Perhaps the rational thing to do at this point is to vow to improve our own conduct in the world. Accept that we are not alone here on this Earth; stop thinking that we have some special entitlement beyond the rest. Quit running red lights and stop signs. Stop racing to get through yellow lights. Hold the door for the person coming through immediately behind you so it won't hit them on their way out. We do it all the time, rush past people to get "there" first. Just because the last time you ran through the elevator door ahead of someone else it didn't result in death, doesn't make you any better than the people at the Nassau Co. WalMart. Maybe we just need to stop and take a minute to think about how we can change our own lives for the better instead of spending so much time condemning others for something than we cannot change.
I disagree with the comments about Walmart not doing anything wrong. There was a reasonable certainty that the crowd would rush the store at opening. It is so blatant and obvious that marketing companies have even made humor out of the rush. There are commercials on TV that depict a temp being the "stuckee" because he is the low man on the employee totem pole that has to face the onslaught. For Walmart to claim it had no reason to believe that their flyers sent out announcing a "limited inventory barn burner" item would not cause pandemonium is ludicrous.
I am normally against lawsuits for compensation of corporate negligence but this one reeks to high Heaven. For the prosecutor to sell out to Walmart makes me believe that there are some underlying motives. I hope that the families of the injured ignore the pittance settlement and go after Walmart individually or collectively.

I hate Wal-Mart with all of my being... but I agree. I don't think they should be accountable for the actions of their customers. Personally, I avoid both Wal-Mart and Black Friday sales because of the shoppers you find there. I shop online only during the holiday season. :)

Enough blame to go around, I guess. They went after WalMart because they can't determine which shoppers were responsible and others were injured as well. It was an "accident" but avoidable as many accidents are. Ultimately, all the shoppers were responsible. Retailers need some crowd control procedures, so Wal Mart is also responsible.
I am curious if any of the shoppers who were present that day bothered to contact the worker's family, maybe send some flowers or donations for the funeral cost, attend the funeral, whatever, something to show some compassion or sorrow for the worker's family. Anonymously if they were concerned about criminal charges. Hopefully it made them think about the next time there was a crowd where they shopped and maybe just think about the other person. Maybe. Hopefully. Or likely, "it wasn't my fault".
I had a kid working for me who was involved in the who concert in cincinnati Ohio a number of years back. This was the first attempt at what they called festival seating. You buy a ticket and sit where ever there was a seat available. The concert people only hired the normal number of security agents as they did for a normal concert. Barney told me he arrived early and was about 4 rows back from the door when they opened it and he said he was suddenly inside 10 yards from where he was standing before the doors opened and his feet had not touched the ground on the way there.
How are you going to tell who was pushing who walked on somebody in a crowd like this . So how are you going to prosecute anyone. It is the responsiblity of the event planners to have enough security to prevent this sort of thing from happening.

Most of you folks are crazy. Wal Mart has probably done more to improve the quality of life for Americans than anyone I know. They have brought the price of essential goods down amazingly for everyone but the poor have benefited most.
I go to Wal Mart and look at the people working there and see that they hire people that often would be rejected at high end shopping outlets giving them a chance to have a job.
It is more trouble to shop there because of the volume of traffic, but i do it because it saves me about 20% or more.

I have talked with many employees......Hate the job, over worked, working shifts they didn't sign up for and the list goes on. If you get a happy employee I am thinking it is a new hire.

Had they gone to court and lost, they would have had to pay the $10,000 fine. But it would have left them open to a civil lawsuit which could have potnentially ended in more than 2 million. Now they can't be sued for this again.
It's not paying $2 million vs. paying $10,000. How much do you think the litigation over several years would have cost versus shutting down the case now? In addition, they got to settle and admit to no wrongdoing. If they went to Trial and lost, what kind of bad press do you suppose they would have gotten.
Bottom line, the settlement decision was based purely on money.
They can still be sued it would of just been a stronger case if they were found criminally negligent. The Attorney is upset because he wasnt given a chance to strong arm wal mart before they settled. He is doing his job but if you dont think attorneys are bastards you must not know any.

I think the reason Walmart was held responsible is that the management at the store had to see how many people were crowding outside the doors before opening, and should've known there was a possibility of someone getting hurt. But let's be honest about Walmart, it's not a place most of us would want to work, and those who do, have to work there because that's all that's out there or that's the best they can do! Their employeee rah rah motivational meetings are required and demeaning to anyone with an ounce of intelligence. I'm going by the stories I've watched on television about the chain. They've kept their costs down by limiting employee benefits, and only after extensive news coverage of the way they stuck it to those who work for them, did they make some changes. Corporate profit over all else has put us in the situation we're in now. Sure, people bought homes they could'nt afford. But how many of those people thought the realtor, and banker who do this for a living and are far smarter than they are did so on their advice? Yes, they should've known if it's too good to be true, it isn't! All are equally responsible for this mess. But who gets the bail out? The millionaire, or billionaire bankers while the others are put out into the street! Sorry but if a corporation is too big to fail, it's too big to exist!

After knowing about three different lawsuits against Walmart, I can say that they are indeed guilty of unfair practices. A friend was knocked over by one of their dairy carts, and when she fell into a dairy case, the employee, rather than helping her, told her to go fill out an accident report. She did that, then went to a hospital the next day only to discover that she had permanent neck and head injuries. When she was released from the hospital, she went back to Walmart to get a copy of the accident form to show her insurance company and the hospital. Alas, Walmart couldn't produce the complaint nor the employee that handled it. He had been transfered to another store out of state. I see something here that is bothersome. How can a DA make such a proposal without considering the burden on that poor person trampled to death? To let the state get involved with a cfivil suit, is pure bull. That same thing happened here in Michigan, Walmart always gets off the hook without taking any responsibility for anything, ever. I think that it is unfair that the power they have with their legal teams that they never have to pay the price for anything. I never shop at Walmart. I don't like what they have done to the general retail market across the country. While they supply our needs with cheap goods made overseas with cheap labor, they take away American jobs, destroy community business', and when they have finally done away with all the competetion, we will wake up to a different story. When that happens and they decide to raise prices sky high, we won't have a choice as to where to buy, all the competition will be long gone. This country was built by Americans with small businesses. We allow our banking, retail, and industrial giants dictate their agenda to us and we take it gullably. We see local businesses close their doors, banks take our assets to Wall Street and Industry ship our jobs overseas and they still have the gall to hide assets in the Caymans to aviod taxation. It is time to dismantle big business, take back our industry, and tell the banking system to keep our money in our communities or get out of our communities. The best step is to close your bank accounts, deposit them in Credit Unions and buy only American goods made by Americans in America. Tell congress you are tired of being controlled by big business and the banking "CARTELS". If you don't think your being swindled, why aren't we making the same amount of interest on CD's that the banks charge on credit cards? Why not?

My experience with Walmart was different. My wife was taking something off a shelf and someone had placed a hunting knife still in the plastic on top of the item my wife was getting down. Then the knife fell off the top she reached out and caught it. The knife punctured the package and my wifes hand. It resulted in a trip to the emergency room and several stitches. They asked me to fill out a report and I told them I needed to take my wife to the hospital. I left them my name and number. A manager called me the next day to find out what happened. I told him the story and he made sure we were reimbursed for all the emergency room expenses and called back a month later to make sure everything was ok with my wifes hand.
I didnt sue them because I know it wasn't their fault. But they did treat me as fairly as can be expected. and took care of all the medical.
It is funny that your friend filled out her own report, first off only a salaried member of management can fill one out. They take information from the person. A copy of it has to be in Home Office's hands in 24 hours or less. It happens just like Brad O'Neil said it did his wife. Secondly, Walmart does not transfer employees like that. A employee has to request themselves a transfer, then find a store with a opening for them. This can take a month or more to do. So no one just disappears, even if the person had already applied for a transfer all they had to do was call the new store. DUH....
And to everyone complaining about Walmart benefits...You have NO idea what you are talking about. Where else can you go and get insurance starting at less than $20.00 a month. The cost is based on what you take out. I have a $500 up front Walmart pays 100% credit, then a $1,000 deductible, then 80/20, with a total out of pocket expense of $5,000 and I pay $40 a month. That is a whole lot better than most programs out there.
As to the workers being uneducated...85% have at least an ASS Degree, if not higher.

As to the reason for this discussion in the first place. Walmart does hand out tickets for larger and high priced item or at least at my store we do, but the type of people who caused this horrible death could have cared less about a piece of paper. Why should Walmart or any other store have to provide crowd control (as if that crowd could have been controlled) we has humans should be responsible for our own actions. When did this practice stop?

Maybe the retail market should offer good deals on a variety of days instead encouraging everyone to kill each other to save a couple of dollars one or two days a year.
I shop on Saturday and Sundays and Black Friday. The WalMart in my area had the same deals and no one acted the way these people did. The procedures were the same. My wife works in retail and has days off during the week and I work nights and would be unable to shop during the week without taking a day off. Whoever said, you need Saturday and Sunday off to make a weekend (I guess the same on who said Breakfast is for mornings only).
It is so sad how everyone always blames Walmart. It's a shame that these grown ass people can't act civilized and walk instead of run..how is that Walmart's fault. It's sad someone had to lose their life over it and it just show's how everyone is out to make a quick buck off of Walmart. I used to work for Sears and I would work for Walmart over them anyday. My husband has worked for Walmart for 10 years and of course they have some issues just like any company but they provide alot for this country and the people that work for them. People need to quite being sue happy and learn how to act like civilized humans during the holidays.
