He claims that because these assets are in his wife's name, that they are complete unconnected to his crimes? Bull@!$%#! Are we to believe that the money he made from essentially stealing it from others was not shared with his family? His wife makes her own money and buys her own homes and all finances between the two are separate? Not only that but his wife was completely unaware of the crimes he was committing?
The only way she should be allowed to keep this money is if she divorces him and he has no access to it (and that is pushing it). Every asset that he is even remotely connected to should be liquidated and used to pay back the people/institutions he robbed. Following that he should go strait to jail till his dying day (and be made to pay for his own stay).
The big reason why he is not in jail yet is because they do not have any suites built yet for him. While he stole all this money from everyone. you can be sure that the lawyers will not steal any of this money and make sure that all the money will be returned to the owners. Yeah Right

Gary, hate to sound harsh, but his wife/family deserves the same consideration he gave to everyone else's husband, wife, child since he was ripping off entire families. Families were victims here; his family should not be immune/protected from his crimes. Where is the protection for the families he has stolen from? ALL of his assets should go to the investors, if you can call them that since, as it turns out, they were investing in NOTHING.

What makes any of us think that they will ever find even a fraction of his assets or his family member assets.
Can we say foreign secret bank accounts. Only one Swiss bank agree that maybe they will share the 50,000 plus secret accounts with the U.S. investigators.
But that doesnot include the 400 other Swiss Banks who have secret accounts!!! And that does not include all the other parts of the World where countries have banks with secret accounts.
I'd hazard a guess the penthouse has been pledged to his attorneys to protect them so they can guarantee their fees defending this nutjob.
For the rest of us plebs, we'd have to make do with a Public Defender. The rest of us would already have had our assets frozen and seized in a case were there is such a preponderence of damning evidence (how much more can you get than a confession of guilt). The rest of us would be sitting in a concrete cell wearing orange waiting the 18-24 months for our case to be heard.And if by chance any of us got granted bail, we sure as heck would have been dragged back in and had it revoked the first time we tried to dispose of any assets.

His clients were as greedy as he was. He was giving them double digit returns when everybody else in the investment sector was losing money in their investments. If something seems too good to be true, it usually is. Clients put too much trust in him, but in all honesty, if he would have been handling their accounts in proper way, they clients would have still been losing money and he would have still gotten his commissions.
He still needs to be punished, but not as badly as many are saying. He's been in business a long time, and majority of his assets have nothing to do with his ponzi scheme. However, he couldn't have run this big a deal by himself. His family had to be involved also.

You are only liable if you do your taxes together. If it is her money then she is entitled to it. But personally I believe that she has used some of that money too and should have to pay it back along with her husband.

I wholly agree. It is unfortunately that Madoff was not caught BEFORE he "turned himself in". That gave him who knows how much time to distribute, donate, etc. his assets among family members so that they would not be, in his mind, accessible for restitution. I sincerely hope that once he is convicted (if he is not - talk about a travesty of justice!!!), ALL of his - and his wife's and family's assets - should be up for consideration and sale to serve as restitution to those he and his family profited by their ponzi scheme. I am sure with enough digging, investigators will find a lot of those assets were "Moved" in recent years for protection. Too bad, Madoff, you may just have to learn to like jail and then learn to live like the rest of us!

They've probably got more than that spread throughout the world. Safety deposit boxes, offshore bank accounts, metal boxes hidden behind walls, and probably a few coffee cans buried in their various back yards. Apparently a person who knew what he was talking about - alerted the SEC - for several years - that Maddoff was a fraud.
The SEC did not listen to this whistleblower until the money was lost.

You are right, the whistle blower put the info in front of the SEC's face and they testified in front of congress that they at the time did not believe there was legitimacy to his complaint. That is why I said in an earlier post that they (SEC) should be held accountable for turning their backs.
It also came out that the SEC should have also seen the robbery that involved Lehman Brothers. According to some economist, they had to be blind or turned their heads to what eventually helped to bring that company down. Remember their CEO walked away with a 47 million dollar bonus 1 month before the company filed for bankruptcy, not only that it was uncovered that the same CEO currently owns properties around the country and some parts abroad that value at more than 100 million dollars total.
How in Hell does this guy 'request' that he keep anything that he 'owns'? None of it is his. He would be lucky to be in a jail cell for the rest of his life.....not in a penthouse with millions of dollars in the bank. He's living in a dreamland crafted from other people's money. You misunderstand God then. As I said, his form of government is not socialism as it is defined by you. His is an association by CHOICE as I said. When half of the people vote for something and the other half have to live under that form of government that they do not particularly choose, that is government by the majority- a democracy (which by the way our government was not set up to be, it was set up as a Republic-- look it up and see that the founders knew that democracy without looking to a higher power would not work and it hasn't. We were set up as one nation, one Republic, Under God. If you do not want anyone ruling your life that is your choice. I have found that God is so good. Why would I or anyone choose to live without him?. "The blessings of the Lord maketh rich (not just in material things), and he adds no sorrow with it". Surely it cannot be that difficult to trace the source of the funds of Ruth to purchase the apartment or fund the accounts that Madoff's lawyer is not trying to protect. There are probably more accounts, real estate etc. that was placed in the name of other family members which now should also be forfeited.
If Ruth wanted to keep the assets in her name only, she should have filed for divorce when she first learned of the Ponzi scheme, which, it seems likely, was quite a while ago.

He deserves to be sleeping in Jail, not out on bail in a multi-million dollar penthouse.
America wants him and his wife, who new exactly what was going on, to go to prison. No liency, they both swindled money from alot of trusting people including their own friends. If the supreme court has to step in to do it, then do it, but please, put these criminals in jail where they belong.
